Nevada Water Division proposes new hearing procedures

  • Nevada Division of Water Resources is proposing new hearing regulations.

June 11, 2024 — The Nevada Division of Water Resources (NDWR) has proposed establishing new rules and amending existing regulations concerning hearing procedures. These procedures, outlined in Chapter 533 of the Nevada Administrative Code (NAC), are relevant to hearings before the State Engineer and encompass pre-hearing steps, including a “meet and confer” between involved parties.

Public Workshop Scheduled.

A public workshop Opens in a new tab.to discuss the proposed changes has been scheduled for Monday, June 24, 2024, at 10:30 a.m. The in-person workshop will be held at the Department of Conservation and Natural Resources Bonnie Hearing Room, 1st floor, 901 S. Stewart Street, Carson City, Nevada. Virtual participation via Teams or telephone will be available for those unable to attend in person.

Proposed Regulations to be Posted Online.

The proposed regulations and relevant materials will be available on the NDWR website at http://water.nv.govOpens in a new tab.. Copies of these materials can also be obtained by contacting the Division at 901 S. Stewart St, Ste 2002, Carson City, Nevada, 89701 or (775) 684-2800. A fee may apply for copying.

Public Input Invited.

The workshop aims to collect oral and written feedback from interested parties regarding the proposed regulations. Individuals interested in providing written comments can do so by emailing ndwr-regscomment@water.nv.govOpens in a new tab. or mailing their input to the Nevada Division of Water Resources at 901 S. Stewart St, Ste 2002, Carson City, Nevada, 89701. The deadline for written comments is June 20, 2024. Submitted testimony will be posted on the NDWR website.

History of Proposed Amendments.

This regulatory update builds upon amendments first proposed under R125-20 and was meant to be continued under R142-22. The workshop will adhere to the Open Meeting Law (NRS 241.020).
